Section 1 Scope
(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between LoveAlchemy, represented by its Managing Director Stephen Doyle (hereinafter "we"), and our customers (hereinafter "Customer") via our online shop, by email, by telephone, or directly on our business premises.
(2) These GTC apply to consumers within the meaning in the Consumer Rights Act 2022 unless otherwise provided in the respective provisions.
(3) Our offer includes, in particular, the sale of Alchemy Crystal Bowls and accessories, digital content, online trainings, in-person trainings, workshops, sound baths, events, retreats, as well as consulting services relating to bowl selection and set curation.
(4) The version of these GTC valid at the time the contract is concluded shall apply.
(5) Any deviating terms and conditions of the Customer shall only apply if we have expressly agreed to them in writing.
Section 2 Conclusion of Contract
(1) The presentation of goods and services on our website or in our online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order or make a booking.
(2) By submitting an order or booking, the Customer makes a binding offer to enter into a contract.
(3) Receipt of the order or booking will be confirmed by email without undue delay. Such confirmation does not yet constitute acceptance unless acceptance is expressly declared therein.
(4) The contract is only concluded upon our express declaration of acceptance, dispatch of the goods, provision of the digital content, or performance of the booked service.
(5) If ordered goods or booked services are unavailable, we are entitled not to accept the offer. Any payments already made will be refunded without undue delay in such case.
Section 3 Subject Matter of the Contract
(1) Depending on the offer, the subject matter of the contract may in particular be:
a) physical goods, in particular bowls and accessories
b) digital content, in particular video, audio, and other online content
c) online trainings and hybrid programs
d) in-person trainings, workshops, sound baths, retreats, and other events
e) consulting services, in particular for individual bowl selection and set curation
(2) Our bowls are regularly hand-selected individual pieces and one-of-a-kind items. Minor natural or production-related deviations in color, shape, structure, surface, material character, sound, or vibration characteristics shall not constitute a defect unless a specific quality has been expressly agreed.
(3) Small production-typical droplets, inclusions, impurities, surface irregularities, or comparable visual features may occur in bowls. Provided that these do not impair the agreed quality, function, or usability, they do not affect quality and shall not constitute a defect.
(4) Audio and video recordings of bowls as well as descriptions on the website serve illustrative purposes. Deviations due to room acoustics, recording quality, speaker systems, or individual perception are possible.
Section 4 Prices and Payment Terms
(1) All prices are final prices including statutory VAT unless otherwise stated.
(2) Any additional shipping, freight forwarding, or other incidental costs will be stated separately prior to conclusion of the contract.
(3) Payment shall be made using the payment methods indicated in the online shop or in the individual offer. No additional fees apply for payment by bank transfer.
(4) Unless otherwise agreed, the invoice amount is payable within 30 days of receipt of the invoice without deduction.
(5) In the case of agreed advance payment, goods will only be shipped or digital content will only be activated after full receipt of payment.
(6) If the Customer defaults on payment, the statutory provisions shall apply. With respect to consumers, default shall occur 30 days after the due date and receipt of an invoice or equivalent statement of payment only if the consumer has been specifically informed of this consequence in the invoice or statement of payment.
(7) Any agreement on deferred payment, payment by installments, or other individual payment arrangements shall remain subject to a separate agreement in each individual case.
Section 5 Delivery, Provision, and Performance
(1) Physical goods shall be shipped to the delivery address specified by the Customer or may be collected from our business premises by prior arrangement.
(2) Delivery times result from the respective product description, offer, or order confirmation.
(3) Digital content and online programs shall be made available to the Customer by activation or transmission of access data after conclusion of the contract and receipt of payment.
(4) Dates for in-person events, live online sessions, workshops, and events result from the respective service description.
(5) We are entitled to make partial deliveries and partial performances where reasonable for the Customer.
Section 6 Retention of Title
The delivered goods shall remain our property until full payment has been made.
Handing Over Prior to Full Payment
If a bowl is handed over to the Customer before full payment has been made, it shall remain our property until full payment has been received. Upon handover, the risk of accidental breakage and accidental deterioration shall pass to the Customer to the extent permitted by law. The Customer's statutory rights in case of defects remain unaffected.
Section 7 Right of Withdrawal
(1) Consumers generally have the statutory right of withdrawal for orders of bowls and other physical goods placed via our online shop. If you are a consumer in the European Union, EU law gives you the right to withdraw from your order within 14 days, without giving any reason. The 14 days begin on the day you, or someone you name, receive the last item in your order. You may also withdraw at any point before your order is shipped.
To exercise this right, simply let us know within the 14 days.
(2) There is no statutory right of withdrawal for bowls and other goods where the purchase contract is concluded on our business premises, unless mandatory statutory provisions provide otherwise.
(3) In the case of contracts for the provision of digital content not supplied on a tangible medium, the right of withdrawal expires prematurely if we have begun performance of the contract after the consumer has
a) expressly agreed that we begin performance before the withdrawal period expires, and
b) confirmed knowledge that by giving such consent, they lose their right of withdrawal once performance begins.
(4) In the case of contracts for the provision of services related to leisure activities, where the contract provides for a specific date or period of performance, there is no right of withdrawal to the extent provided by law. This may apply in particular to scheduled sound baths, workshops, retreats, and comparable events.
(5) For other services that are neither digital content nor scheduled leisure services within the meaning of paragraph 4, the statutory provisions apply. The right of withdrawal expires prematurely if we have fully performed the service and the consumer has previously
a) expressly agreed that we begin performance of the service before expiry of the withdrawal period, and
b) confirmed knowledge that they lose their right of withdrawal upon full performance of the contract.
(6) Entrepreneurs do not have a statutory right of withdrawal.
(7) There is no right of withdrawal for contracts concerning the delivery of bowls that are not prefabricated and are manufactured on the basis of an individual selection or determination by the Customer, or that are clearly tailored to the Customer's personal needs.
Section 8 Goodwill Exchange for Bowl Purchases Made on Our Business Premises
(1) For bowls purchased on our business premises, we voluntarily and without acknowledgment of any legal obligation grant the possibility of an exchange.
(2) Any exchange shall be made solely at our discretion
a) for other goods, or
b) in the form of a voucher.
(3) There is no entitlement to repayment of the purchase price in cash within the framework of this voluntary goodwill exchange.
(4) A prerequisite for any exchange is that the bowl is in undamaged, unaltered, and resalable condition.
(5) We reserve the right to charge a handling fee in the amount of 20% of the original purchase price for such goodwill exchange.
(6) Statutory rights in case of defects remain unaffected.
Section 9 Warranty
(1) The statutory provisions concerning material defects and defects of title shall apply.
(2) The statutory limitation period for claims based on defects in new goods is two years from delivery, unless mandatory statutory provisions provide otherwise.
(3) Natural and production-related deviations in one-of-a-kind items, in particular with regard to color, material, surface, structure, sound, resonance behavior, as well as small production-typical droplets, inclusions, impurities, or comparable visual features, shall not constitute a defect unless a specific quality has been expressly agreed and provided that function or usability is not impaired.
(4) Any manufacturer's warranties or seller guarantees shall apply only if expressly granted.
Section 10 Liability
(1) We shall be liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
(2) In the event of slightly negligent breach of essential contractual obligations, we shall only be liable for the typical and foreseeable damage. Essential contractual obligations are those whose fulfillment is necessary for the proper performance of the contract and on whose compliance the Customer may regularly rely.
(3) In all other cases, liability for slight negligence is excluded.
(4) Liability under the German Product Liability Act remains unaffected.
Section 11 Rights of Use for Digital Content
(1) All content provided in connection with our online trainings, programs, courses, and other offers, in particular videos, audios, scripts, texts, photographs, working materials, and recordings, is protected by copyright.
(2) The Customer is granted a simple, non-transferable right of use exclusively for personal use.
(3) Any transfer, reproduction, publication, recording, editing, or commercial use without our express prior consent is prohibited.
Section 12 Data Protection
(1) We process personal data exclusively in accordance with the applicable data protection laws.
(2) Further information can be found in our separate privacy policy at [insert link].
Section 13 Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Section 14 Applicable Law and Place of Jurisdiction
(1) The law of the Republic of Ireland shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, insofar as mandatory consumer protection provisions do not provide otherwise.
(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from the contractual relationship shall be our registered office.
Section 15. Cancellations and Returns
RETURNS & RIGHT OF WITHDRAWAL
Every bowl that leaves our studio is wrapped with great care and sent to you with intention. We want you to feel held at every step, including the moment you change your mind. This is how returns, cancellations, and your right of withdrawal work at AKI.
YOUR 14-DAY RIGHT OF WITHDRAWAL
If you are a consumer in the European Union, EU law gives you the right to withdraw from your order within 14 days, without giving any reason. The 14 days begin on the day you, or someone you name, receive the last item in your order. You may also withdraw at any point before your order is shipped.
To exercise this right, simply let us know within the 14 days.
CANCELLING BEFORE YOUR ORDER SHIPS
If you wish to cancel before your bowl has been dispatched, use the same withdrawal form or write to us, and we will stop the order and return your payment in full.
YOUR REFUND
We will wait until your returned items reach us, and are confirmed to be in original condition and undamaged. Refunds are made to your original payment method.
RETURNING YOUR BOWL WITH CARE
Alchemy Crystal Singing Bowls are precious, living instruments, and they are fragile. If you are returning one, please:
- Return it in its original packaging, packed in the same way it was sent to you, so it travels safely home.
- Photograph the bowl before you repack it — 6 photos in total (all 4 sides, the top, and the base) — and email them to us at info@lovealchemy.ie
- Send it fully insured for its full value, by a tracked courier such as UPS. Return shipping is arranged and paid by you.
- Send your return within 14 days of telling us you are withdrawing. If that day falls on a weekend or holiday, the next business day is fine.
You are welcome to unwrap and handle your bowl to understand its nature and sound, just as you would in our studio. The photographs and original packaging help us confirm its condition and care for you if anything is amiss.
If you are unsure how to pack, photograph, or handle your bowl, please reach out before sending it. We are always here to guide you.
IF YOUR BOWL ARRIVES DAMAGED
In the rare event a bowl arrives broken, please photograph the packaging exactly as it reached you, before and as you open it, and contact us straight away at info@lovealchemy.ie. At delivery, inspect the package for any visible damage; if you have any doubt, photograph the unopened package with the driver present and open it in their presence. Damage that occurs after opening, through accident or play, is not covered by the 14-day guarantee, as our bowls do not break on their own.
